These Terms of Service (“Terms”) explain how this website and the services offered by AEY Wellness, LLC doing business as AEY Metabolic Health (“we,” “us,” or “our”) may be used. By visiting this website, purchasing services, or participating in any programs, you agree to these Terms.

If you do not agree, please do not use this website or our services.

AEY Wellness, LLC operates under the assumed business name AEY Metabolic Health.
References to “AEY Metabolic Health,” “AEY,” “we,” “us,” or “our” throughout these Terms refer to AEY Wellness, LLC.

1. Our Services

We offer personal training and wellness coaching services designed to support general fitness, wellness, and healthy habits. Services may include:

  • Customized exercise programming

  • Wellness and lifestyle coaching

  • Educational fitness resources

  • General guidance on nutrition, supplements, macros, and meal timing

  • One live video session per month (currently standard)

Most services are delivered through the Everfit Coach app, along with messaging and scheduled video sessions.

As the business evolves, we may adjust how services are delivered, including the format or frequency of sessions. Any material changes will be communicated when reasonably possible.

2. Not Medical or Healthcare Services

Our services are provided for educational and general wellness purposes only.

We do not provide medical care, medical advice, diagnosis, or treatment. We also do not provide nutrition therapy, mental health counseling, or emergency services.

Any information shared through this website, our programs, surveys, messages, or video sessions is not a substitute for advice from a licensed healthcare professional. You are responsible for consulting with qualified professionals before starting an exercise program, changing your diet, or using supplements.

3. Who May Use Our Services

You must be 18 years or older to use our services.

By participating, you confirm that:

  • You are physically able to engage in exercise

  • You will share relevant health information honestly

  • You take responsibility for deciding whether participation is appropriate for you

For safety reasons, we reserve the right to decline or discontinue services at our discretion.

4. Exercise Risks and Personal Responsibility

Physical activity carries inherent risks. By using our services, you understand and agree that:

  • Injuries or health issues can occur even with proper instruction

  • You voluntarily assume all risks associated with participation

  • You are responsible for monitoring how you feel during and after exercise

We do not monitor clients in real time and cannot respond to emergencies. If you experience a medical emergency, call 911 or your local emergency number immediately.

5. Forms, Surveys, and Client Data

Initial discovery forms, health questionnaires, and wellness surveys are completed through the Everfit app and remain stored within your individual Everfit profile.

We do not store health or wellness information locally on our own systems. By using our services, you acknowledge that:

  • Everfit is a third-party platform

  • Your use of Everfit is subject to its own terms and privacy policy

  • We are not responsible for Everfit’s data handling, outages, or system issues

We may retain limited administrative records (such as billing and communications) as required for business or legal purposes.

6. Payments and Billing

Payments are processed through Squarespace Payments and Stripe, a third-party billing provider.

Clients may choose between:

  • A one-time purchase, or

  • A monthly subscription

Billing, cancellations, and billing history are managed directly through your Squarespace Payments and Swipes account. We do not control third-party billing platforms and are not responsible for errors or service interruptions caused by them.

7. Cancellations and Refunds

Subscriptions may be canceled by the client at any time through their billing account. Cancellations take effect according to the terms shown at the time of cancellation.

Refunds, if offered, follow the refund policy presented at purchase. Unless otherwise stated, unused services are not refundable once a billing period has begun.

We may terminate services for non-payment, safety concerns, misuse of services, or violations of these Terms.

8. Ownership of Content

All programs, materials, and content we provide are owned by the Company and protected by intellectual property laws.

Clients receive a limited, non-transferable license to use materials for personal use only. Sharing, copying, selling, or redistributing content without written permission is not allowed.

9. Communications

By using our services, you agree to receive communications related to scheduling, program delivery, and billing.

Marketing messages, if offered, are optional and subject to opt-in requirements.

10. No Guarantees

Results vary from person to person. We do not guarantee specific outcomes, including changes in fitness level, body composition, or health status.

11. Limitation of Liability

To the extent permitted by Minnesota law, we are not liable for injuries, losses, or damages related to participation in our services or reliance on information provided.

If liability is found, it will not exceed the amount paid for services during the one-month period prior to the claim.

12. Indemnification

You agree to hold harmless and indemnify the Company from claims or expenses arising from your participation, failure to disclose relevant health information, or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Minnesota. Any legal disputes must be brought in Minnesota courts.

14. Updates to These Terms

We may update these Terms occasionally. Continued use of the website or services after changes are posted means you accept the revised Terms.
